Introduction

Eritrea is a sovereign state and will remain sovereign through the will, sacrifice, and resilience of its people. The sovereignty of Eritrea is inseparable from the sovereignty and dignity of the Eritrean people themselves. As Eritreans, we have the right and responsibility to criticize, question, and define the current regime and its policies. However, such criticism must never come at the expense of Eritrean sovereignty or the collective sovereignty of the Eritrean people. Advocacy for justice, constitutional governance, and democratic reform is not a rejection of Eritrea’s independence; rather, it is a commitment to protecting and strengthening the nation and its citizens.

As Eritrea approaches its Independence Day in May, the struggle for justice and democratic governance becomes even more poignant, particularly for Eritrean justice seekers in the diaspora. These individuals and groups have emerged as vital catalysts for political awareness and civic engagement, advocating for the rule of law in a country where democratic institutions are almost non-existent. The current political climate under the People’s Front for Democracy and Justice (PFDJ) has created an urgent responsibility for diaspora communities to act as voices for accountability and human rights.

Understanding Sovereignty vs. Absence of Rule of Law

Sovereignty is often defined as the authority of a state to govern itself and make its own laws. However, in Eritrea, the absence of rule of law under the PFDJ has complicated this concept. While Eritrea is recognized as a sovereign state, the lack of constitutional governance undermines the very essence of sovereignty, leaving citizens without the protection of their rights.

• Centralized Power: Under Isaias Afwerki, Eritrea has become synonymous with centralized authority, indefinite national service, and the suppression of dissent.

• No Constitutional Guarantees: The ratified constitution has never been implemented, meaning citizens lack institutional protections for their rights.

• Sustaining Long-Term Engagement: Challenges such as displacement and economic pressures make it vital to maintain civic engagement across generations.

The Path Toward Rule of Law in Eritrea

For Eritrea to transition to a state of justice and democratic governance, several foundational steps are necessary:

• Implementation of the Constitution: Establishing constitutional rule as the legal foundation for governance is crucial.

• Establishment of Independent Institutions: Courts and legislative bodies must operate independently from executive control.

• Protection of Fundamental Rights: Guarantees of freedom of speech, assembly, and political participation are essential.

• National Reconciliation: An inclusive dialogue process is necessary for healing and bridging political divisions.

• Empowerment of Civil Society: Independent organizations must play a central role in rebuilding society.

• Diaspora Partnership in Nation Building: Eritrean professionals abroad can contribute their expertise toward a democratic transition.

Conclusion

Eritrean justice seekers in the diaspora are essential to the struggle for accountability, governance, and the rule of law. Their efforts transcend mere political opposition; they represent a growing civic movement dedicated to restoring constitutional order and empowering citizens.

At the same time, Eritrea is a sovereign state and will remain sovereign through the determination and unity of its people. Eritreans have the legitimate right to criticize and define the current regime, demand accountability, and advocate for democratic reforms. However, such criticism should never undermine Eritrean sovereignty or the sovereignty of the Eritrean people themselves. The pursuit of justice, constitutional governance, and human rights must always be rooted in the protection of Eritrea’s independence, national dignity, and collective future.

While the path toward justice in Eritrea is fraught with challenges, the unity, principled leadership, and sustained commitment from both those within the country and the diaspora can make a difference. The aspiration for freedom, accountability, and the rule of law remains vibrant among the Eritrean people, promising a future where justice prevails.
